Abstract

According to this study, the writer is talk about Transaction Overview Normative Juridical Pornography in The Perspective of Regulation No.11 Year 2008 Article 27 Paragraph (1) On Information and Electronic Transaction and Regulation No.44 Year 2008 On Pornography. According to the writer, the intention of the tittle itself is to find out what arrangements governing the Transaction of Pornography. Based on the intention of the tittle above, this thesis will explain about: 1. How arrangements regarding pornography transaction in perspective of regulation No.11 year 2008 article 27 paragraph (1) on information and electronic transaction and regulation No.44 year 2008 on pornography? 2. What are the sanctions for the perpetrators and disseminators of the content of pornography transaction under the regulation no.11 year 2008 and regulation no.44 year 2008? The result of this study are, based on regulation no.11 year 2008 article 27 paragraph (1) about pornography transaction said, a person may not distribute and/or transmits the inaccessibility of electronic information that has a charge of violating decency and according to regulation no.44 year 2008 about pornography which pornography transaction regulated in several regulation such as article 4 paragraph (1) which describes each person is prohibited to disseminate, obtain explicitly contains about mating, nudity and so forth, article 5 which explain each person is prohibited to downloading pornography and last, article 6 which describes every person is prohibited to displaying, play and have pornographic products. The sanctions imposed on offenders who deliberately committed the crime of pornography transaction based on regulation no.11 year 2008 article 45 paragraph (1) about information and electronic transaction and based on regulation no.44 year 2008 article 29 paragraph (1), article 31 and also article 32 about pornography.
